Licensed store, CBD shop or smoke shop?

A Google Maps search for a dispensary in Montclair turns up CBD shops, smoke shops and listings named like dispensaries that are not on the state's list. Before you go anywhere, run the Cannabis Regulatory Commission's own checks:

  • It is on the state map. Search the CRC's dispensary map by town or ZIP code. A store is added once it tells the CRC it is open.
  • The license is on the wall. Licensed stores must display their CRC license certificate, and Montclair's code also requires the township license to be posted.
  • They check your ID. Every customer must be 21 or older.
  • Everything is from New Jersey. Licensed stores sell only cannabis grown and made in the state.
  • You pay tax and get a receipt. At The Library that is 6.625% sales tax plus West Orange's 2%.

Montclair's cannabis rules, in plain English

Montclair regulates cannabis in Chapter 110 of its code, with the store locations in its zoning chapter (347) and the local tax in Chapter 309. What it means for a shopper:

  • Three stores at most. The township may issue up to three retail licenses (§ 110-7, last amended April 21, 2026).
  • Bloomfield Avenue or Valley Road only. Stores are allowed on Bloomfield Avenue, the west side of Lackawanna Plaza, or Valley Road between Walnut and James Streets (§ 347-80D(6), § 347-90J), and at least 250 feet from a school or licensed child-care center (§ 347-17.2).
  • Closed overnight. No store may be open between 11 p.m. and 8 a.m. (§ 110-12A).
  • No lounges, no use on site. Consumption areas are banned in Montclair (§ 110-19), and nothing may be used on a cannabis business's premises (§ 110-18).
  • 2% local tax on Montclair sales. Montclair adds 2% to sales by stores in the township (§ 309-40). Buy in West Orange and you pay West Orange's 2% instead (§ 22-3), on top of New Jersey's 6.625%.
  • Not in the parks. Montclair's smoke-free rules count marijuana smoke and cover township parks, playgrounds and recreation areas, with a $250 fine for a first offense (Chapter 234).
