The Three Category Caps: Flower, Concentrate, Edibles
The New Jersey Cannabis Regulatory Commission (NJ-CRC) sets three independent per-transaction purchase limits at every licensed adult-use retailer. The caps are written into the NJ Cannabis Regulatory, Enforcement Assistance, and Marketplace Modernization Act and the regulations published at N.J.A.C. 17:30. They have been in force since the start of recreational sales in April 2022 and are enforced at the point-of-sale system.
Per-Transaction Purchase Limits at NJ Licensed Retailers
- Flower: 1 ounce (28.35 g) per transaction
- Concentrate: 5 grams per transaction (includes wax, shatter, rosin, distillate cartridges, and other extracts)
- Edibles: 1,000 milligrams of THC per transaction (typically 100 servings of 10 mg each)
- Pre-rolls: Counted toward the 1 oz flower cap by total weight
- Vape cartridges: Counted toward the 5 g concentrate cap by total cannabis content
- Beverages: Counted toward the 1,000 mg edible cap by total THC content
- Tinctures and topicals: Treated under the 1,000 mg category by total THC
The three categories are independent, which means a single customer can purchase the maximum from each category in the same transaction. A fully maxed-out basket would include 1 ounce of flower, 5 grams of concentrate, and 1,000 milligrams of edible THC. Most visitors purchase well below these caps. The caps exist as ceilings, not targets.
The retailer's point-of-sale system calculates the running total against each category cap as items are added. If a basket exceeds a cap, the system blocks checkout and the cashier identifies which item to remove. Retailers face significant penalties if they exceed limits, so they enforce caps strictly and consistently.
Visitor Rules: ID, Payment, and How Caps Apply to Out-of-State Buyers
New Jersey adult-use law does not differentiate between residents and visitors. The same 1 oz / 5 g / 1,000 mg per-transaction limit applies equally to a Newark resident, a New Yorker on a day trip, and an international visitor arriving at EWR. The retailer's only legal check is that the customer is 21 or older with a valid government-issued photo ID. There is no New Jersey residency requirement.
What Visitors Need to Bring
- Valid government-issued photo ID. US driver's licenses, US passports, and foreign passports are all accepted (NJ-CRC).
- Cash or US-supported debit card. Credit cards are not accepted for cannabis purchases anywhere in the United States.
- Foreign debit cards on Visa or Mastercard networks typically work. ATMs are usually located inside or near the dispensary.
- A plan for legal consumption. Public consumption is prohibited statewide. Hotel rooms are governed by hotel policy and the NJ Smoke-Free Air Act.
- Awareness that cannabis cannot legally cross state lines or pass through TSA security on a return flight.
Visitors should plan their purchase against actual consumption needs for the duration of the trip. Cannabis purchased in New Jersey cannot legally leave the state, and most retailers do not accept returns of opened products. Buying in proportion to planned use is the cleanest approach.
Compliance Flow: How to Stay Within Limits at Checkout
The compliance flow at a licensed New Jersey dispensary is short, predictable, and designed to keep both the customer and the retailer within NJ-CRC rules. Following the steps below makes for a smooth visit.
- Bring valid photo ID. Adults 21 and older only. Foreign passports are accepted.
- Plan your basket against the three category caps. 1 oz flower, 5 g concentrate, 1,000 mg edibles per transaction. Mix freely.
- Bring cash or US-supported debit. Credit cards are not accepted. ATMs are typically on-site.
